3 13-01-2014 Heard learned counsel for the petitioner and learned
counsel for the State.
Petitioner seeks bail in a case registered for the offence
punishable under section 379 of the Indian Penal Code.
It is contended that the case was registered against
unknown and the stolen motorcycle is alleged to have been
recovered from possession of the petitioner. Learned counsel
further contended that the petitioner was not aware that the
motorcycle in his possession is stolen one. Motorcycle belongs to
the petitioner’s friend Vivek Kumar who fled away on seeing
police party.
Be that as it may, taking into consideration the fact that
the petitioner is in custody since 22 nd November, 2012, he is
directed to be released on bail on furnishing bail bond of Rs.
10,000/- (Ten thousand) with two sureties of the like amount each
