The petitioner seeks anticipatory bail in connection with Chakia P.S Case No.428 of 2012 registered for the offences punishable under sections 465, 468, 467, 477, 471, 474, 477A and 120B of the Indian Penal Code and section 7 of the Essential Commodities Act.

It is contended that the petitioner is not named in the FIR. The wheat loaded on two trucks was seized while being unloaded at the rented premises of the petitioner. It is also contended that the seized wheat has already been released by the Collector, West Champaran calling for a report from the Assistant Godown Manager, Harsidhi Godown, State Food Corporation in favour of

the petitioner. The petitioner has produced cash memo, VAT licence and other documents before the Collector in the confiscation case. It has also been contended that no offence under the Essential Commodities Act is made out and the petitioner is neither a PDS dealer nor there is allegation that he indulged in black marketing.

Be that as it may, taking into consideration the facts and circumstances of the case, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Chakia P.S. Case No.428 of 2012 subject to the conditions as laid down under section 438(2) Cr.P.C.
