2 28-05-2014 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered for the offence punishable under Sections 341, 323, 504, 448, 453, 307, 379, 506/34 of the Indian Penal Code.
It is submitted that the petitioner and the informant are own brothers and due to the family dispute false case was

instituted and for the alleged occurrence dated 25.11.2013, the first information report was lodged on 05.12.2013 i.e., after delay of about 10 days. It is further submitted that injury report does not support the allegation of assaulting by rod as it reveals that injury has been caused by the sharp-edged object. That apart, it is also submitted that both brothers have compromised the case and a petition in this regard has been filed.
Having regard to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Bahadurpur (Sonki) P.S. Case No.418 of 2013, the petitioner, Sudhir Kumar Thakur shall be released on bail on furnishing bail bond of Rs.10,000 ( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
