Petitioners apprehend their arrest in connection with a case registered for the offence under Section 498(A)/34 of the Indian Penal Code. Petitioners are brother-in-law (Bhaisur) of the informant. It is submitted that there is general and omnibus allegation against the petitioners and other accused persons are concerned except the husband of the informant against whom there is specific allegation. As per allegation set out in the First Information Report, despite compromise having been arrived at between the parties after which the informant stayed for about

eight months at her matrimonial house, husband and wife were unable to lead a conjugal life. It is further submitted that all the ladies, who are also accused in the present case namely Most. Shanti Devi, Lalita Devi, Uma Devi and Munni Devi, have already been granted anticipatory bail by the Sessions Judge.

Having regard to the facts and circumstances of the case, let the petitioners, namely, Upendra Singh and Babban Singh, be released on bail in the event of arrest/surrender before the court below within a period of six week from today in Simra P.S. Case No.01 of 2014 on furnishing bail bond of Rs.10,000/(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad, subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
