Petitioners apprehend their arrest in connection with a case registered for the offences under Sections 420 and 406 of the Indian Penal Code.
As per allegation, the petitioners could not supply the required quantity of rice within time.
Learned counsel for the petitioners submits that vide Annexure-2 dated 03.09.2012, they were directed to supply 24504.31.680 quintals of rice till 10.10.2012. However, even prior to that, the F.I.R. has been lodged making allegation that the paddy supplied for milling was kept in open field. It is further

submitted that even thereafter petitioners are regularly supplying rice in support of which they have appended truck challans as Annexure-3 series.
Having regard to the facts and circumstances of the case, let the petitioners, namely, Sapna Thakur and Gopal Singh, be released on bail in the event of arrest/surrender before the court below within a period of six week from today in Dumra P.S. Case No.250 of 2012 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi, subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
