Petitioner apprehends his arrest in connection with a case registered for the offence punishable under Sections 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted on behalf of the petitioner that allegation of firing is upon co-accused Sandeep Kewat and so far petitioner is concerned, ingredients of Section 307 of the Indian Penal Code are not made out. It is submitted that petitioner is having no criminal antecedent.

Having regard to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Sarmera P.S. Case No.105/2013, the petitioner, Lalan kewat shall be released on bail on furnishing bail bond of Rs.10,000 ( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the C.J.M., Biharsharief, Nalanda subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
