Petitioners apprehend their arrest in a case registered for the offences punishable under sections 341, 323, 324, 307/34 of the Indian Penal Code.

It is submitted by learned counsel for the petitioners that petitioner no. 1 is the full brother of the informant whereas petitioner no. 2 is the son of petitioner no. 1. It is contended that admittedly there is a dispute between the parties regarding partition. Petitioner no. 1 had earlier made a complaint before the police upon which Maker Police Station Case No. 61/2012 was registered on 10.09.2012 itself. It is further submitted that the injury appears to be lacerated and skin deep only and the petitioners are not having any criminal antecedent.

Having regard to the facts and circumstances of the case, let

the abovenamed petitioners, Ram Nath Singh and Mintu Singh @ Rishi Pratap Singh @ Rishi Kumar Singh, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Maker Police Station Case No. 24 of 2013 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of the C.J.M., Saran at Chapra, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
