3 22-04-2014 Both the above applications have been heard together and are being dispose of by this common order as they have arisen out of one occurrence. The petitioners seek bail in a case which has been registered for offence under Sections 399 and 402 of the Indian Penal Code and 25 (1-B)A/26 and 35 of the Arms Act. A raid was conducted on receipt of confidential

information about assemblage of some criminals to commit some serious offence and during raid the petitioners were apprehended along with others.

Submission is that the petitioners were merely present there and they have been apprehended on suspicion. There is no recovery from possession of the petitioners. In paragraph 3 of both the above applications it has been mentioned that the petitioners have no criminal antecedent and have never involved in any criminal case.

Considering the facts and circumstances of the case, let the above named petitioners of both the applications be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate/concerned court, Dehri, Rohtas in Dehri (T) P.S.Case No. 7 of 2014.
