JUSTICE V.N. SINHA ORAL ORDER 2 06-06-2013 Heard learned counsel for the petitioner and the State. Petitioner is accused in Bettiah Town P.S. Case No. 682/12 registered for the offence under Sections 302, 120(B)/34 and other allied Sections of the Penal Code and Section 27 of the Arms Act lodged against unknown. Petitioner has been implicated in this case during investigation. He was adjudged to be a juvenile under order dated 22.12.2012.

Notwithstanding the fact that petitioner has been declared juvenile by the competent Juvenile Justice Board his request for bail is not being allowed as according to Juvenile Justice Board and the appellate authority his release on bail is likely to bring him in association with known criminals.

It is submitted on behalf of the petitioner that his antecedent prior to his being made accused in the present case was absolutely clean. From perusal of order passed by the Juvenile Justice Board and the appellate authority it does not appear that

any material has been produced by the prosecution agency if petitioner is released on bail, he is likely to be associated with known criminals.

In such circumstances, I have no option but to set aside the orders passed by the Juvenile Justice Board dated 4.2.2013 as also the appellate authority dated 10.04.2013 whereunder request of the petitioner for grant of bail has been rejected. Having set aside the two orders, I direct the petitioner named above to be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of Juvenile Justice Board, Bettiah in connection with Bettiah Town P.S. Case No. 682 of 2012 (J.J.B. Tr. No. 287 of 2013). The two bailors of the petitioner should be his father and another close relative.
