Learned counsel for the petitioner has not filed any slip that the case be not taken up during summer vacation. Even yesterday the case was taken up for admission but counsel for the petitioner did not appear, as such, matter was passed over with observation that in case counsel for the petitioner does not choose to appear on 05.06.2013, matter shall proceed on merit. Even today counsel for the petitioner is not present.

Petitioner husband is apprehending his arrest in connection with a case registered for the offence under Section 498A, 494 of the Penal Code and Section ¾ of the Dowry Prohibition Act. He has not only ill treated his first wife Puja Devi but also has taken another wife Reshma Devi (Opposite Party No. 4 in Complaint Case No. 1423/2011).

In the circumstances, I am not inclined to grant

bail in the event of arrest to the petitioner. His prayer for bail in the event of arrest is, accordingly, rejected with direction to surrender in the court below within four weeks from the date of receipt/production of a copy of this order in the court below and apply for regular bail in connection with Complaint Case No. C.A. 1423/2011, which should be considered in accordance with law.
