Petitioner Block Development Officer is apprehending his arrest in connection with a case registered for the offence under sections 467, 468, 471, 420, 409/34 of the Indian Penal Code alleging misappropriation of fund released for execution of the scheme under the Indira Housing Scheme for the year 2006-07.

It is submitted on behalf of the petitioner that he is not named in the first information report which has been lodged by Shri Suryanand Singh husband of the candidate who lost election for the post of Mukhiya against the present Mukhiya of the Gram Panchayat and the Panchayat Secretary. Petitioner is not named therein but has been implicated during investigation though none of the beneficiary under the scheme has alleged against him. It is further submitted that present case has been lodged on account of political malice at the instance of the candidate who lost the election.

Petitioner having not been named in the first information report but his implication in the case has transpired during investigation as such in my opinion, surrender in the court below within four weeks from the date of receipt/production of a copy of this order in connection with Tarabari P.S. Case No. 45 of 2012 (G.R. No. 1324 of 2012) in the court below and apply for regular bail which should be considered in the light of the material collected against him during investigation. It shall be open for the petitioner to file a petition in the court below for calling for the case diary in advance.
