ORAL ORDER
3 10-04-2013 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 143, 323, 324, 353, 504 of the I.P.C. and 33(1-B), 41/42 of the Forest Act.
One tractor loaded with stones was intercepted by the forest officials when two persons were apprehended but subsequently 40-50 persons got released the tractor along with the apprehended persons, out of which two persons were identified as Upendra Prasad and Sanjeev Manjhi. The name of the petitioner sprang up since petitioner was running the crushing machine.
It is submitted by learned counsel for the petitioner that petitioner was neither identified on the spot nor any recovery has been made from the petitioner and only on suspicion the accusation has been levelled when a statement

has been made in para 17 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Jehanabad in connection with Forest Case No. 14 of 2010, arising out of Makhdumpur P.S. Case No. 367 of 2009.
