JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 10-04-2013 It is submitted that petitioner no. 2 has been arrested, hence, his application has become infructuous and accordingly, it is disposed of.
Petitioner no. 1 is apprehending his arrest in a complaint case in which cognizance has been taken for the offences punishable under Sections 302/34 of the Indian Penal Code.
It is alleged by the complainant that he entered into the house and found his wife dead when the children suggested that petitioners stabbed the wife of the complainant.
It is submitted by learned counsel for the petitioner that the accusation was found false and final form was submitted and admittedly the complainant was not the eye witness to the occurrence, but subsequently

on protest the cognizance has been taken.
Considering the aforesaid facts, let the above named petitioner no. 1 be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Kishanganj in connection with Complaint Case No. C-16 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
