Petitioner apprehends his arrest in connection with Madanpur P.S. Case No. 228 of 2012 registered for the offences punishable under Sections 414 and 120 B of the Indian Penal Code.

Admittedly, nothing has been recovered either from conscious possession of the petitioner or from his house and the alleged recovery has been made from the house of other person and the occupant of the aforesaid house disclosed this fact that it were petitioner and some others who had kept the seized article in her house.

Learned counsel for the petitioner informs that petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as

well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within three weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Madanpur P.S. Case No. 228 of 2012 subject to condition as laid down under Section 438(2) of the Cr.P.C.
