Petitioner apprehends his arrest in connection with Chhatapur P.S. Case No. 71 of 2012 registered for the offence punishable under Section 409 of the Indian Penal Code.

Petitioner being Panchayat Sewak was appointed to execute scheme no. 12/03-04 in which a community hall had to be constructed in Chhatapur village and accordingly, he took advance but did not deposit the measurement book as well as vouchers.

Learned counsel for the petitioner submitted that petitioner got constructed the aforesaid community hall but before completion of the aforesaid community hall, he was transferred from block Chhatapur and he hander over his charge. Chhatapur block, one Manoj Kumar Maheshpuri joined as Panchayat Sewak and he took rupees seventy five thousand for completion of aforesaid community hall but did nothing for which Chhatapur P.S. Case No. 61 of 2012 was registered against him and in the aforesaid case, Manoj Kumar Maheshpuri has already been granted privilege of anticipatory bail by a Bench of this Court vide order dated 29.11.2012 passed in Cr. Misc. No. 41222 of 2012.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within three weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul in Chhatapur P.S. Case No. 71 of 2012 subject to condition as laid down under Section 438(2) of the Cr.P.C.
