Earlier prayer for bail of the petitioner was rejected by this court; vide order dated 17-08-2012 passed in Cr. Misc. No. 30478 of 2012 considering the nature of allegation levelled against him as also facts and circumstances of the case.

Learned counsel for the petitioner submits that the petitioner is in jail custody since long but uptill now, his trial has not been concluded.

Learned trial court has reported vide letter No. 124 dated 02-05-2013 that out of 11 prosecution witnesses, altogether 9 prosecution witnesses; including the doctor and one of the I.Os. have already been examined.

In the aforesaid circumstances, the prayer for bail of the petitioner, in connection with Sessions Trial No. 565 of 2012 arising out of Kadwa (Balia Belon) P.S. Case No. 116 of 2012 pending in the court of Additional Sessions Judge-II, Katihar is, again rejected.

However, the informant is directed to appear before the learned trial court for his deposition on the very next day of receipt of this order to the concerned court and, furthermore, learned trial court is directed to conclude the trial of the petitioner as early as possible.
