Earlier the prayer for bail of the petitioner was rejected by this Court vide order dated 14.09.2012 passed in Cr. Misc. No. 27421 of 2012 on the ground that there was recovery of country made pistol and cartridge from conscious possession of the petitioner and altogether nine cases had been registered against him but submission on behalf of the petitioner is that out of aforesaid nine cases, petitioner has already been acquitted in seven cases whereas in two cases, he has been directed to be released on bail and so far as present case is concerned, he is languishing in jail custody for near about 15 months.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No. 57 of 2012 subject to condition that he shall attend the trial court on each and every date in person for the period of nine months or till conclusion of his trial whichever is earlier and if he fails to do so on two consecutive dates without any genuine cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
