The petitioner has been arrested in connection with Amarpur P.S. Case No. 168 of 2012, registered under Sections 147, 148, 149, 341, 323, 324 and 307 of the Indian Penal Code.
There is allegation that occurrence took place with regard to informant ousted the cow of the petitioner from his field by which this petitioner assaulted Raju Mansuri by bhala and lathi and Suleman Mansuri gave farsa blow on the head of Azad Mansuri.
Learned counsel for the petitioner submits that post mortem report as well as injury report does not suggest of assault by bhala as the injury caused by hard and blunt substance. However, injury report on the person of Azad shows lacerated wound of 2”x 1’4” scalp deep over middle of scull with profuse bleeding. However, the victim died after fifteen days of the occurrence.

Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Amarpur P.S. Case No. 168 of 2012, subject to condition that petitioner will appear on each and every date fixed in this case.
