JUSTICE GOPAL PRASAD ORAL ORDER 5 02-05-2013 Heard learned counsel for the petitioner and learned counsel for the State. The petitioner has been arrested in connection with S. Tr. No. 25A of 2012 arising out of Amba P.S. Case No. 36 of 2009, registered under Sections 147, 148, 149, 427 and 121(A) of the Indian Penal Code, 3/4 of the Explosive Substance Act, 17 C.L.A. Act as well as 3/4 of Prevention of Damage to Public Property Act.

There is allegation that 10-15 accused persons including this petitioner were seen around the place where bombarding was done and damaged the pool.

Learned counsel for the petitioner submits that none has seen the occurrence as such and only four persons were seen at the place of bombarding except that there is no material against the petitioner. It is further submitted that petitioner is in jail custody since 19. 07. 2011.

Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned trial court (F.T.C.-V), Aurangabad, in connection with S. Tr. No. 25(A) of 2012 arising out of Amba P.S. Case No. 36 of 2009, subject to condition that petitioner will file Hazri in the nearest police station once in a fortnight for one year and he will not involve in such activity in future.
