appearing on behalf of the State.
The petitioner seeks regular bail in a case registered for offences punishable under Sections 25(1-b) a, 26 of the Arms Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. As per the prosecution story, on an information, the Police raided the place of occurrence and saw the petitioner alongwith one other fleeing away after throwing a polythene bag in the field. The petitioner was arrested and in the polythene bag, a country-made pistol was found by the Police and was seized.
Learned counsel for the petitioner submits that even on the basis of the First Information Report, it cannot be said that the said country-made pistol was recovered from the petitioner’s possession. The petitioner is in custody since 30.04.2013.

In view of the above, let the petitioner Indradeo Choudhary be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Khagaria in connection with Khagaria P.S. Case No. 249 of 2013.
