The petitioner seeks regular bail in a case originally registered for the offences under Sections 341, 323, 324, 325, 307 and 504 of the Indian Penal Code to which Section 302/34 has subsequently open committed.
Learned counsel for the petitioner submits that there is specific allegation of assault by the co-accused Umesh on the thigh of the deceased by an iron rod. There is no allegation against this petitioner of any assault. He further submits that the similarly situated co-accused Pappu Sah has been granted bail by this Court by order dated 01.08.2013 passed in Cr.Misc. no. 25056 of 2013.
In view of the submission as aforesaid, let the petitioner be released on bail on furnishing bonds of Rs.10,000/-
