The petitioners seek regular bail in a case registered for the offence punishable under Sections 302,147,148 and 149 of the Indian Penal Code

Petitioners have no criminal antecedent. As per the prosecution case, the accused persons, eight in number, forming an unlawful assembly assaulted the informant’s son Puna Manjhi brutally with Lathi etc, leading to death of the informant’s son.

Learned counsel for the petitioners, referring to the First Information Report contends that there is no specific allegation of any overt act on the part of these petitioners. It is submitted that there is general and omnibus allegation against

them.

In view of the above, let the petitioners, namely, Upendra Manjhi, Brahmadeo Manjhi, Dhano Manjhi and Kuldeep Manjhi, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Kowakole ( Rupow) P.S. case No. 82 of 2013.
