The petitioner seeks regular bail in a case registered for the offences punishable under Sections 363 and 373 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case by the informant and the allegation, as contained in the First Information Report, that the victim girl named this petitioner to have committed the offence is falsified by the subsequent statement of the victim girl, recorded under Section 164 of the Cr. P.C. He submits that in the statement made under Section 164 of the Cr. P.C., the victim has specifically stated that she did not know the name of the lady who had taken her to the market whereas in the First Information Report, the allegation is that the victim girl had named this petitioner.

It has been submitted on behalf of the petitioner that the petitioner has been implicated because of certain internal politics in the village and the petitioner has no criminal antecedent.
In view of the above, let the petitioner Saimul Khatoon be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. (West), Muzaffarpur, in connection with Maniyari P.S. Case No. 136 of 2013.
