No.9/2013/49A/12/251/12, arising out of Tekari P.S. Case No.273 of 2009 registered under Sections 386 and 387 of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act and Section 17 of the Criminal Law Amendment Act.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. itself that the petitioner was not arrested at the spot in course of raid conducted by the police at the house of Mukesh Singh of village-Girsindhi rather the name of the petitioner has been disclosed by two ladies, Renu Devi and Binda Devi, who is said to have present there and seen the accused persons, namely, Baldeo Rabidas, Mangal Singh

and others, fleeing away on seeing the police party. It is further

submitted that the petitioner is in custody since 31.10.2012.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.D.J.-III at Gaya, in connection with Sessions Trial No.9/2013/49A/12/251/12, arising out of Tekari P.S. Case No.273 of 2009. Out of the two sureties, one must be either parents or close relative of the petitioner.
