JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 22-02-2013 It is submitted that the petitioner no.1 has been arrested, hence his application with regard to anticipatory bail application has become infructuous.

The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 353, 323, 504, 224, 225, 212 and 332 of the Indian Penal Code.

It is alleged that in a case registered under Sections 363, 366A and 120B of the IPC, one Raj Kumar Das and Awadhesh Das were apprehended when the petitioners along 20-25 unknown persons forcibly got them released from the police custody.

It is submitted by learned counsel for the petitioners that a statement has been made in para 13 of the petition that the petitioners have no criminal antecedent when the accusation is omnibus and general.

Considering the aforesaid facts, let the above named petitioners except petitioner no.1 be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Kadwa (Balia-Belon) P.S. Case No. 308 of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.
