The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420 and 120B of the Indian Penal Code.

The accusation against the petitioners is of selling the land of the complainant by abducting the grand father of the complainant.

It is submitted by learned counsel for the petitioners that Title Suit No. 449 of 2003 is pending for annulment of the sale deed and other Title Appeal No. 33 of 2009 with regard to the said land is also pending between the parties and for the sale deed executed in 2003 the complaint was filed in 2010.

Considering the aforesaid facts, let the above

named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Raxaul at East Champaran, Motihari in connection with Complaint Case No. C309 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
