2 12-09-2013 All the above-said petitions arise out of Samho P.S. Case No. 28 of 2012 registered under Sections-302/34 of the Indian Penal Code and 27 of the Arms Act and accordingly, all the above-said petitions are being disposed of by this common order.

Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State.
Altogether 16 persons, including these petitioners, are named in the first information report and the informant claimed in her fardbeyan that when she reached near her husband, her husband disclosed that at the instigation of accused, Jalo Yadav, co-accused, Birju Yadav, S/o Late Bhagwan Yadav opened fire
upon him.
Learned counsel appearing for the petitioners points out that having similar allegation, co-accused, Makeshwar Yadav, Mantun Yadav, Khojo Yadav and Manoj Yadav have already been granted bail by a bench of this court.
Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioners, namely, Rajniti Yadav (in Cr. Misc. No. 30942 of 2013), Ram Sewak Yadav (in Cr. Misc. No. 31122 of 2013), Birja Yadav, Pramod Paswan and Mathura Paswan (in Cr. Misc. No. 31206 of 2013) be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Samho P.S. Case No. 28 of 2012 to the satisfaction of the learned R.R. Raman, J.M.-Ist Class, Begusarai.
