The trial court has reported that order dated 03.08.2012 passed in Cr. Misc. No. 22102 of 2012 has never received in his court but charge against the petitioner has already been framed. The trial court has also reported that if prosecution adduces its evidences in time, he would take step to conclude the trial of the petitioner within nine months.

In view of the aforesaid report as well as grounds mentioned by me in my previous order dated 03.08.2012 passed in Cr. Misc. No. 22102 of 2012, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Sessions Trial No. 407 of 2012 arising out of Bettiah Town P.S. Case No. 412 of 2011 pending in the court of Additional Sessions Judge-III, West Champaran, Bettiah is again rejected.

However, learned trial court is directed to conclude

the trial of the petitioner within the period as fixed by the trial court itself. It is made clear that if the trial of the petitioner is not concluded within the above stated period, the petitioner may renew his prayer for bail before the trial court itself.

Let this order be communicated to the court of Additional Sessions Judge-III, West Champaran, Bettiah in connection with above stated case through fax at the cost of the petitioner.
