Heard learned counsel for petitioner no. 2 as well as learned Additional Public Prosecutor for the State.
The informant came to know about the alleged occurrence from Pramod Kumar who happens to be younger son of co-accused, Prakash Yadav and it is prosecution case that Pramod Kumar disclosed this fact that petitioner and other accused administered poison to the deceased.
The contention on behalf of the petitioner no. 2 is that in course of trial above stated Pramod Kumar has been declared hostile and moreover, according to prosecution case itself, it was Prakash Yadav who had illicit relation with the wife of the deceased.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner no. 2, namely,

Manoj Yadav be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Nawadah in connection with Pakribarawan P.S. Case No. 163 of 2012 corresponding to Sessions Trial No. 272 of 2012.
