JUSTICE DINESH KUMAR SINGH ORAL ORDER 07/ 19-02-2013 Heard learned counsels for the petitioner, the State and the complainant. The petitioner is apprehending his arrest in a complaint case in which cognizance has been taken for the offence punishable under Section 420 of the Indian Penal Code.
It is alleged by the complainant that he gave loan of Rs.10,42,000/- to the petitioner, but subsequently a cheque of Rs.50,000/- was issued by the petitioner which got bounced. The present case of the complainant is that he gave Rs.5,45,000/- through bank transactions out of which Rs.5,00,000/- has been returned but the rest amount of Rs. Five lakhs and odd have not been returned.
Considering the fact that the money which has been given through the bank transaction has almost returned by the petitioner, let the above named petitioner

be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna in connection with Complaint Case No. 3474(C) of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
