JUSTICE DINESH KUMAR SINGH ORAL ORDER 6 18-02-2013 In pursuance to the order dated 31.01.2013, the Deputy Superintendent of Police, Motihari, is present with the case diary in Court. Heard learned counsels for the petitioner and the State. The petitioner being the District Panchayat Raj Officer, Director Accounts (Administration) is apprehending his arrest in a case registered for the offences punishable under Sections 409, 420, 467, 468 and 471 of the Indian Penal Code. It is alleged that the informant and 93 others received training of Kaushal Vikas Scheme of Panchayat Raj Department. They ought to have received Rs. 31,300/- each instead of that the informant received only Rs. 10,150/- and the total money to the tune of Rs. 29,42,200/- has been misappropriated by the petitioner and others.

It is submitted by learned counsel for the
petitioner that subsequently the informant has
retracted from his initial version and filed a
petition to that effect before the learned court
below.

It is submitted by learned counsel for the
State that the alleged offence is ruled out.

Considering the nature of accusation, let
the petitioner, above named, be released on bail
till conclusion of investigation in the event of
arrest or surrender before the learned court below
within a period of twelve weeks from today in
connection with Motihari Town P.S. Case No. 195 of
2010 on furnishing bail bond of Rs.10,000/-(Ten
Thousand) with two sureties of the like amount each
to the satisfaction of the learned C.J.M. Motihari,
subject to the conditions as laid down under Section
438(2) of the Code of Criminal Procedure.
