The petitioner being the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 342, 341, 323, 324, 420, 467, 468, 307, 504, 498A/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.

The accusation is of making assault and torture in various ways.

Though, the informant has received injuries also, but learned counsel for the petitioner submits that petitioner undertakes to keep the informant as wife with full dignity and honour.

The offer is acceptable to the learned counsel appearing for the informant.

petitioner shall appear before the learned court below on 4^th of March, 2013 when the petitioner will take the informant to her matrimonial home to keep her as wife with full dignity and honour.

Considering the stand of the petitioner, let the above named petitioner be released on provisional anticipatory bail for one year in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh in connection with Athmalgola P.S. Case No. 159 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The provisional bail of the petitioner will be confirmed within one year by the learned court below on substantial restoration of the matrimonial harmony or if the informant deliberately refuses to reside with the petitioner.
