2	04-09-2012 Heard learned counsel for the petitioner and learned
	counsel for the State.
	The petitioner has been arrested in connection with
	Daudpur P.S. Case No. 120 of 2011 registered under Sections 409/34 of the Indian Penal Code.
	It is alleged that petitioner was submitting charge to
	Ram Narayan Singh in the year 2011, but he had received paper
	only from 2001 to 2005, but records, cash book, pass book, cheque book, original register has not been received from 2006 to 2011 so business of Panchayat is affected. Learned counsel for the petitioner submits that petitioner
	in his show cause has stated that the then Mukhiya has taken
	records by force and hence he has admitted that he has not been
	charge of his office. It is further submitted that from the

impugned order of the Additional Sessions Judge, it appears that petitioner has handed over the charge but there is no document to support this fact.

Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Chapra (Saran) in connection with Daudpur P.S. Case No. 120 of 2011 corresponding to G.R. No.3950 of 2011, subject to condition that petitioner shall cooperate with the investigation and he handed over all the papers if he has submitted charge then he will shown the document showing his bonafide of having submitting papers. Further condition he will cooperate with the police during investigation and produced document against other accused persons.
