Heard learned counsel for the petitioner and the State. This is a petition for grant of regular bail for offence under Sections 302, 380 and 411/34 of the Penal Code.
There is allegation that the idols of Asth Dhatu weighing about 25 Kg each of Ram Janki and Laxmanjee theft away after murdering the priest of Ram Janki Temple. However, the idols were recovered along with this petitioner and one Santosh Kumar Sah. The learned counsel for the petitioner submits that the offence took place on 07.06.2011, the recovery is made on 20.12.2011 and the co-accused, Santosh Kumar Sah, having similar allegation has been granted bail in Cr. Misc. No. 16910 of 2012, and the case of the petitioner stands on similar footing. The petitioner is in jail since 13.01.2012.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Brahmpur (Krishnabraham) P.S. Case No. 110 of 2011 to the satisfaction of the Chief Judicial Magistrate, Buxar, subject to the condition that the petitioner shall appear in Court on each and every date, fixed in the case and any absence, on two consecutive dates, without any reasonable ground to the satisfaction of the Court below, shall be a ground of cancellation of bail of the petitioner by the lower Court itself.
