2 04-09-2012 Heard learned counsel for the petitioner, the investigation and the State.
This is a petition for grant of regular bail for offence under Sections 307 and 34 of the Penal Code and 3 and 5 of the Explosive Substances Act.
It is alleged that the petitioner exploded bomb and after the explosion the petitioner along with others came. The learned counsel for the petitioner contends that the allegation of explosion is concocted. The petitioner surrendered on 08.05.2012. It has also been submitted that other co-accused, Manoj Kumar, who has been seen fleeing away, has been granted bail by this Court in Cr. Misc. No. 32438 of 2012.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Nawada (Town) P.S. Case No. 52 of 2008 to the satisfaction of the Chief Judicial Magistrate, Nawada, subject to the condition that he will file hazari in the nearest Police Station once in fortnight for six months and if any criminal activity of the petitioner is pointed out, then, the trial Court shall proceed for cancellation of the bail bond and the petitioner shall not indulge in such activity further and if he indulges, then, the deponent must inform the Court about the indulgence of the petitioner and the Court below, itself, shall, proceed to cancel the bail bond of the petitioner.
