The petitioner has been arrested in connection with Sessions Case No. 138 of 2012 arising out of Basahani P.S. Case No. 30 of 2011, G.R. No. 1975 of 2011, registered under Sections 304(B) and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that marriage solemnised of the petitioner with the victim within two and half years, though, there is allegation of demand of motorcycle, but this part of allegation has not been substantiated in case diary. Further in the statement of informant and other witnesses nor there is any allegation or material to suggest that victim was subjecting to cruelty and witnesses are of Naihar people of the victim stated that at the time of occurrence the petitioner was at Delhi.

Learned counsel for the State does not deny this submission of the learned counsel for the petitioner.

Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Adhoc Additional Sessions Judge III, Saharsa, in connection with Sessions Case No. 138 of 2012 (arising out Basanahi P.S. Case No. 30 of 2011) G.R. No. 1975 of 2011.
