This is a petition for grant of regular bail for offence under Section 307 of the Penal Code.

There is allegation that one person caught hold of the informant and assaulted by khurpi. The petitioner has not been named in the first information report and his name finds place in paragraphs 4, 5 and 6 of the case diary. It has been asserted that the petitioner was identified as the person who inflicted the injury. In paragraph 32 of the case diary the injury is said to be stitching. However, it has been stated that the opinion can not be given due to stitching injury, which is shown to be dangerous to life. However, it has come that the petitioner is insane and there is no motive for the occurrence. The petitioner is in jail since 21.10.2011.

Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Vidyapati Nagar P.S. Case No. 129 of 2011 to the satisfaction of the Additional Chief Judicial Magistrate, Dalsing Sarai, Samastipur, subject to the condition that one of the bailors shall be a close relative like brother of the petitioner, who will affidavit to the effect that the petitioner shall not indulge in such activity further and if he indulges, then, the deponent must inform the Court about the indulgence of the petitioner and the Court below, itself, shall, proceed to cancel the bail bond of the petitioner.
