The limited grievance of the petitioner is that his own damage claim has not b
een settled by the Branch Manager, New India Assurance Company, Ltd., Bistupur Branch, Jamshed
pur (opposite party no.1). It is borne out from the record that the petitioner is the register
ed owner of vehicle bearing Regd. No.JH-05-AT-8943, which met with an accident on 10.02.2016 a
t Belda U.P. School, N.H.49, Keonjhar. The vehicle was thereafter shifted to Keonjhar Town Pol
ice Station. A criminal case has also been initiated with respect to such accident bearing G.R
. Case No.179/2016 of the court of learned SDJM, Keonjhar, arising out of Koenjhar Town P.S. C
ase No.37/2016 for the alleged commission of offence under Sections 279, 337, 304-A of the IPC
It is the case of the petitioner that the vehicle is not a position to be move
d as it is fully damaged and it is parked inside the premises of the Koenjhar Town Police Stat
ion. Though this fact has been intimated to the opposite party no.1, he is not taking any step
s for settling the claim.
In that view of the matter, the writ petition is disposed of directing opposit
e party no.1 to take a decision on Annexure-4 stated to be have filed on 12.07.2017 and dispos
e of the same, after affording reasonable opportunity of hearing to the petitioner, within a p
eriod of 45 days from the date of production of certified copy of this order, by reasoned orde
r. The petitioner undertakes to produce a certified copy of this order along with a copy of th
e brief before the authority within fifteen working days.
Urgent certified copy of this order be granted as per rules.
