11.10.2017 Heard learned counsel for the petitioners and learned Addl. Government
Advocate for the State.
In this writ petition, the petitioners, being the petitioners in R.P. Case No.
1122/2016 have filed an application under Section 15(b) of the Odisha Survey and Settlement Ac
t, 1958 (hereinafter referred to as the Act for brevity) before the opposite party no.2. The l
imited prayer of the petitioners is that their case is not being taken up for final disposal b
y the opposite party no.2.
The learned Addl. Government Advocate, on the other hand, submits that thousan
ds of cases are pending before the opposite party no.2 and unless a ground is made out for ear
ly disposal of the case, no mandamus can be issued.
Keeping in view the aforesaid submissions made by the learned counsel for the
parties, this Court disposes of the writ petition giving liberty to the petitioners to file an
application before the opposite party no.2 for early disposal of the aforesaid Revision case
within a period of ten working days. On such event, the opposite party no.2 shall consider whe
ther there is any good reason for expeditious disposal of the Revision Case filed by them and
if there are some good grounds, opposite party no.2 shall take a decision thereon subject to p
endency of the cases before him and other legal priorities, if any.
Urgent certified copy of this order be granted as per rules. .

In the interim, it is directed that the further proceeding in Execution Case N o.229/2015 passed by the learned District Judge, Cuttack shall remain stayed till the next dat e. Urgent certified copy of this order be granted as per rules.
