2. 08.12.2016 The petitioner having been implicated in C.T. Case No. 858 of
2016 arising out of Soro P.S.Case No. 426 of 2016 registered for alleged offence under Section
s 47 (A) of Bihar & Orissa Excise Act pending in the court of learned J.M.F.C., Soro has file
d this application for grant of anticipatory bail.
Heard learned counsel for the petitioner and learned Additional Government Adv
ocate.
Considering the submission and viewing the nature of accusations against this
petitioner, while being not inclined to grant anticipatory bail to him, it is observed that in
the event the petitioner surrenders in the court below within 15 days hence and moves for his
release on bail, the same shall be considered of on its own merit and disposed of in accordan
ce with law without being influenced by this order during the first hour so as to enable the p
etitioner to approach the higher forum during the second half of the day in case necessity so
arises for its disposal during the course of the day unless there stands any legal impediment.
The case record be made available in the meantime.
ABLAPL is accordingly disposed of.
