2. 8.12.2016 The petitioners having been implicated in G.R. Case No.217 of 2016 a
rising out of Ranpur P.S. Case No.226 of 2016 registered for alleged commission of offence und
er sections 341/325/294/307/34 IPC pending in the court of learned J.M.F.C., Ranpur have filed
this application under Section 438 of the Cr.P.C. for grant of anticipatory bail.
Learned counsel for the petitioners submits that there is case and cou
nter case for the same incident and the specific allegation of assault is against petitioner n
o.1.
Learned Addl. Standing Counsel opposes the move.
Considering the submission, viewing the nature of accusations and othe
r surrounding circumstances of the case, in the absence of any other impediment, I am inclined
to grant anticipatory bail to the petitioner no.2 and not the petitioner no.1. Accordingly,
it is directed that in the event the petitioner no.2 surrenders before the court in seisin of
the case within a period of fifteen days hence and moves for his release on bail, he be releas
ed on bail on such terms and conditions as would be deemed just and proper by the said court.
However, it is observed that in the event the petitioner no.1 surrende
rs before the court in seisin of the case and moves for his release on bail, the same shall be
considered on its own merit and disposed of in accordance with law early without being influe
nced by this order.
