Mr. Ramlal Meena has sent the present undated letter petition to this Tribunal by post, which has been treated and registered as O.A. No. 72/2026 for exercise of suo moto jurisdiction in view of law laid down by

Hon’ble Supreme Court in Municipal Corporation of Greater Mumbai vs. Ankita Sinha, (2022) 13 SCC 401.

“ विषय: - मानसरोिर डेंटल एिं आयुिेविक मेवडकल कॉलेज, कोलार रोड, भोपाल द्वारा सीिेज का पानी खेतों में छोडे जाने से कोलार क्षेत्र की 20% आबािी पर कैंसर एिं अन्य गंभीर स्वास्थ्यगत संकट के संबंध में कठोर काययिाही हेतु वनिेिन ।

हम, ग्राम वहनोवतया आलम के कृषक एिं अपनी वमलन कॉलोनी तथा फॉर्च् य न स् ट े कॉलोनी एिं आस-पास के क्षेत्रीय रहिासी, आपको अत्यंत व्यथा एिं आक्रोश के साथ सयवित करना िाहते हैं वक मानसरोिर डेंटल कॉलेज, कोलार रोड, भोपाल द्वारा प्रवतविन भारी मात्रा में गंिा सीिेज का पानी खुले खेतों में छोडा जा रहा है। यह पानी खेतों से होते हुए अपनी वमलन कॉलोनी में वबजली के टॉसफामयर के पास से छोटी सी नहर के द्वारा फॉर्च् य न एस् ट े कॉलोनी एिं कोलार के सबसे प्रवसद्ध स्कॉन मंविर तक पहुंि रहा है इस छोटी सी नाली रूपा नहर से वहनोवतया ऑलम की लगभग 130 एकड भयवम वसंवित होती है और इसी भयवम की सब्ज़ि यां, गेहं, िािल आवि कोलार क्षेत्र की लगभग 20 प्रवतशत आबािी तक पह ु िती हैं।

मानसरोिर डेंटल कॉलेज तथा आयुिेविक मेवडकल कॉलेज अब वकसानों एिं आसपास के रहिावसयों के वलए एक अवभशाप बन िुका है। इस पानी में भयंकर िुगंध फैल रही है और आस-पास के कॉलोवनयों (रूबी भगिान स् ट े, अपनी वमलन कॉलोनी, फॉर्च् य न एस् ट े कॉलोनी) के समस्त बोरिेलों का पानी पीने योग्य नहीं रह गया है (पानी का टेस्ट करिा जा सकता है शासन के द्वारा)। इस प्रियवषत पानी के सेिन से और इस पानी में पैिा हुई सब्ज़ि यों ि फलों को खाने से लोगों में कैंसर, हैजा, टायफाइड, मलेररया, डेंगय, पेट एिं आंतों के संक्रमण, िस्त, डायररया, पीवलया, हैपेटाइवटस, वकडनी और वलिर की बीमाररयाुँ, त्विा रोग, श्वसन संबंधी रोग (िम घुटना, अस्थमा, एलजी) जैसी गंभीर बीमाररयाुँ तेजी से फैल सकती है

हमने कई बार मानसरोिर डेंटल कॉलेज को इस बारे में सयवित वकया, परंतु समस्या के समाधान के बजाय हमें टालने की कोवशश की गई। एिं स्थानीय प्रशासन भी इस कायय में डेंटल कॉलेज के पयणयतः साथ प्रवतत हो रहा है।

माननीय महोिय, ब्जस्थवत यह है वक -

इस कॉलेज में लगभग 700 छात्र-छात्राएुँ और स्टाफ रहते हैं, वजनका संपयणय मल-मयत्र सीधे इस गंिे पानी में वमल रहा है। यही गंिा पानी खेतों, सब्जियों और अनाज के माध्यम से कोलार की जनता तक पह ु ि रहा है।

अपनी वमलन कॉलोनी एिं फॉर्च् य न स् ट े कॉलोनी एिं आस-पास की बब्जस्तयों एिं कोलार के सबसे प्रवसद्ध स्कॉन टेंपल तक यह सीिेज का पानी पहुंि रहा है। साथ ही पास की कॉलोवनयों जैसे "रूबी भगिान स् ट े एिं अपनी वमलन कॉलानी" के बोरिेलों का पानी पयणयतः ियवषत हो िुका है, वजसे नागररक पीने ि घरेलय उपयोग हेतु मजबयरीिश इस्तेमाल कर रहे हैं। क्ोंवक इन कॉलोवनयों को नल जल योजना से नही जोडा गया है।

इसी कारण इस क्षेत्र में कैंसर, मलेररया, पेट संबंधी रोग और अन्य संक्रमणजन्य बीमाररयों के मरीजों की संख्या लगातार वपछले 1 िषय से वनरंतर बड रही है यवि आपको विश्वास नही है तो आप पास के ही अस्पतालों की OPD से जानकारी प्राप्त कर सकते है। वजससे आपको सत्यता का पता िल जायेगा।

अतः, हम सभी वकसान एिं कॉलोनीिासी आपसे मांग करते हैं वक -

मानसरोिर डेंटल कॉलेज पर तुरंत कठोर िंडात्मक काययिाही की जाए।

कॉलेज को आिेवशत वकया जाए वक सीिेज का पानी खेतों या नालों में छोडना पयणयतः बंि करें।

जब तक यह व्यिस्था सुवनवित न हो, तब तक कॉलेज के संिालन पर तत्काल रोक लगाई जाए।

अपनी वमलन कॉलोनी (वहनोवतया आलम िौक से बैरागढ वििली रोड पर ब्जस्थवत कॉलोनी) के टॉसफामयर के पास से अिैद्ध नली का वनमायण वकया गया है उसे तत्काल बंि वकया जाये,

अन्यथा भविष्य में इस तहर पुनः कोई अन्य इस नाली में सीिेज वमलाकर पुनः जल को प्रिुवषत करता रहेगा।

कानयनी धाराओं का उल्लंघन - मानसरोिर डेंटल कॉलेज का यह कृत्य स्पष्ट रूप से आपरावधक और िंडनीय है:-

पयायिरण संरक्षण अवधवनयम, 1986 (धारा 15)- वबना उपिार के प्रियवषत जल प्राकृवतक स्रोत में वमलाना अपराध; िंड : 5 िषय कारािास या 1 लाख जुमायना या िोनों।

जल (प्रियषण वनिारण एिं वनयंत्रण) अवधवनयम, 1974 (धारा 24(1)) – अपवशष्ट जल नहर/निी में डालना पयणयतः प्रवतबंवधत; िंड: 18 माह सजा, 10,000 रूपये जुमायना और प्रवतविन 5,000 रूपये अवतररक्त िंड।

भारतीय िंड संवहता (IPC) धारा 269, 270, 277 – जल स्रोत ियवषत कर रोग फैलाने का अपराध; िंड: कठोर कारािास एिं भारी जुमायना ।

पयायिरण संरक्षण अवधवनयम 1986, जल अवधवनयम 1974, IPC की धारा 269/270/277, और नगर वनगम अवधवनयम का उल्लंघन ।

अनुच्छेि 21 - जीिन एिं व्यब्जक्तगत स्वतंत्रता का अवधकार

स्वच्छ जल और स्वास्थ्य का अवधकार जीिन के अवधकार का वहस्सा है।

o गंिा पानी वमलाने से नागररकों का यह अवधकार छीना जा रहा है।

अनुच्छेि 47 - राज्य का कतयव्य

राज्य का िावयत्व है वक िह जनता के स्वास्थ्य स्तर को ऊुँिा रखे। कॉलेज की गवतविवध इसके विपरीत है।

अनुच्छेि 48-A - पयायिरण की रक्षा

राज्य का िावयत्व है वक िह िनों, झीलों, नवियों और पयायिरण की रक्षा करे।

o कॉलेज ने उल्टा पयायिरण को नष्ट करने का कायय वकया।

अनुच्छेि 51-A (g) नागररकों का मौवलक कतयव्य

पयायिरण की रक्षा करना हर नागररक का कतयव्य है।

“Subject: Request for strict action regarding the discharge of sewage water into agricultural fields by Mansarovar Dental & Ayurvedic Medical College, Kolar Road, Bhopal, causing cancer and other serious health crises affecting approximately 20% of the population of the Kolar area.

Respected Sir,

¶56

We, the farmers of village Hinotiya Alam and the residents of Apni Milan Colony, Fortune State Colony, and nearby areas, wish to inform you with deep anguish and anger that Mansarovar Dental College, Kolar Road, Bhopal, is releasing a large quantity of filthy sewage water daily into open agricultural fields. This water flows through the fields and, via a small channel passing near the electricity transformer in Apni Milan Colony, reaches Fortune Estate Colony and the most famous ISKCON Temple of Kolar. Through this small drain-like canal, approximately 130 acres of land of Hinotiya Alam are irrigated, and vegetables, wheat, rice, etc., grown on this land reach nearly 20% of the population of the Kolar area.

Mansarovar Dental College and the Ayurvedic Medical College have now become a curse for farmers and nearby residents. A severe foul smell is spreading from this water, and the borewell water of surrounding colonies (Ruby Bhagwan State, Apni Milan Colony, Fortune Estate Colony) is no longer fit for drinking (this can be tested by the government). Consumption of this polluted water and food grains, vegetables, and fruits grown using it can rapidly spread serious diseases such as cancer, cholera, typhoid, malaria, dengue, gastrointestinal and intestinal infections, diarrhea, dysentery, jaundice, hepatitis, kidney and liver diseases, skin diseases, and respiratory illnesses (suffocation, asthma, allergies). We have repeatedly informed Mansarovar Dental College about this issue, but instead of resolving it, attempts were made to evade responsibility. The local administration also appears to be fully supporting the dental college in this matter.

Respected Sir, the situation is as follows:

1. Approximately 700 students and staff reside in this college, whose entire human

waste (urine and feces) directly mixes into this filthy water. This same contaminated water reaches the people of Kolar through fields, vegetables, and

food grains.

¶62

2. This sewage water reaches Apni Milan Colony, Fortune State Colony, nearby

¶63

settlements, and even the most famous ISKCON Temple of Kolar. Additionally, the borewell water of nearby colonies such as Ruby Bhagwan State and Apni Milan Colony has become completely contaminated, which citizens are compelled to use for drinking and domestic purposes, as these colonies are not connected to the tap water supply scheme.

3. Due to this, the number of cancer, malaria, stomach-related diseases, and other infectious disease patients in this area has been continuously increasing over the past one year. If there is any doubt, information can be obtained from the

OPD records of nearby hospitals to verify the truth.

Therefore, all of us farmers and colony residents demand that:

1. Immediate and strict punitive action be taken against Mansarovar Dental College.

2. The college be ordered to completely stop discharging sewage water into fields or drains.

¶70

3. Until proper arrangements are ensured, the operation of the college should be immediately suspended.

4. The illegal pipeline constructed near the transformer of Apni Milan Colony (located on the Hinotiya Alam Square to Bairagarh Chichli Road) should be immediately sealed/removed; otherwise, in the future, others may again mix sewage into this drain and re-pollute the water.

Violation of Legal Provisions:

The acts of Mansarovar Dental College are clearly criminal and punishable:

1.Environment Protection Act, 1986 (Section 15): Discharging polluted

water

into natural sources without treatment is an offense; punishment: up to 5 years imprisonment or a fine of 1 lakh, or both.

¶77

2. Water (Prevention and Control of Pollution) Act, 1974 (Section 24(1)): Discharging wastewater into canals/rivers is strictly prohibited; punishment: 18 months imprisonment, ₹10,000 fine, and an additional ₹5,000 per day.

3. Indian Penal Code (IPC) Sections 269, 270, 277: Offense of spreading disease by contaminating water sources; punishment: rigorous imprisonment and heavy fine.

4. Violation of the Environment (Protection) Act, 1986; Water Act, 1974; IPC Sections 269/270/277; and the Municipal Corporation Act. Violation of the Constitution:

1. Article 21-Right to Life and Personal Liberty

¶81

The right to clean water and health is part of the right to life.

¶82

By mixing dirty water, this right of citizens is being taken away.

¶83

2. Article 47 - Duty of the State

¶84

It is the duty of the State to raise the level of public health.

¶85

The activities of the college are contrary to this duty.

¶86

3. Article 48-A-Protection of Environment. It is the duty of the State to protect forests, lakes, rivers, and the environment.

The college has instead worked to destroy the environment.

4. Article 51-A(G) - Fundamental Duty of Citizens

¶89

Protecting the environment is the duty of every citizen.

¶90

The college has violated this duty as well.”

The Applicant has not appeared before this Tribunal today physically or through V.C. However, instead of dismissing the application in default, we grant an adjournment for appearance of the Applicant before this Tribunal physically or through V.C.

Even though the present case has been listed before this Bench by registering original application on the basis of complaint made by the

Applicant with approval and under order of Hon’ble Chairperson, but in view of the facts and circumstances of the case including the fact that the place of accrual of cause of action lies within jurisdiction of the Central Zone Bench of this Tribunal at Bhopal, we are of the considered view that it will be appropriate if the case is heard by the Central Zone Bench of this Tribunal at Bhopal.

Accordingly, the Registry is directed to list the matter before the Central Zone Bench of this Tribunal at Bhopal on 12.03.2026 after obtaining orders from Hon’ble the Chairperson for transfer of the case, if so required.

The Applicant is directed to join the proceedings physically or through V.C. and to produce the material available with him on the date fixed before the Central Zone Bench of this Tribunal at Bhopal.
