Mr. Lakshmikant Tiwari made the present complaint dated 26.08.2025 to this Tribunal on Public Grievances Portal, which has been treated and registered as O.A. No. 69/2026 for exercise of suo moto jurisdiction in view of law laid down by Hon’ble Supreme Court in Municipal Corporation of Greater Mumbai vs. Ankita Sinha, (2022) 13 SCC 401.

महोदय,

विषयांवकि है वक रीिा के पहावड़या, बक्छेरा में स्थावपि MSW Energy Solutions Pvt. Ltd. को नगर वनगम द्वारा अनुबंवधि वकया गया था वक िह रीिा, सीधी एिं िहडोल विलों से उठाए गए नगर वनगम कचरे का प्रोसेवसंग कर विद्युि उत्पादन करेगी।

वकन्तु िितमान में कंपनी द्वारा अनुबंध की ििों का उल्लंघन करिे हुए बाहर के राज्ों (वििेषकर प्रयागराि, उत्तर प्रदेि) से ट्रकों के माध्यम से भारी मात्रा में कचरा लाकर िलाया िा रहा है। इस कृत्य से स्थानीय नागररकों को अनेक समस्याओं का सामना करना पड़ रहा है, िैसेबाहर से आने िाले ट्रकों द्वारा मागत एिं पहाड़ी क्षेत्रों में कचरा वगराए िाने से भारी गंदगी एिं प्रदूषण फैल रहा है।

स्थानीय नागररकों को दुगंध एिं धुएँ के कारण स्वास्थ्य संबंधी गंभीर समस्याएँ उत्पन्न हो रही हैं। भारी ट्रकों की आिािाही से प्रधानमंत्री सड़क (लगभग 5 वकमी क्षेत्र) पूरी िरह क्षविग्रस्त हो गई है, विससे स्थानीय लोगों को आने-िाने में अत्यवधक परेिानी हो रही है।

कंपनी द्वारा क्षेत्र में वकसी भी प्रकार की CSR गविविवधयाँ संचावलि नहीं की िा रही हैं।

नगर वनगम एिं प्रदूषण वनयंत्रण विभाग द्वारा अपेवक्षि वनगरानी एिं कारतिाई नहीं की िा रही है। कंपनी केिल वनिी लाभ हेिु बाहर का कचरा लाकर िला रही है, िो अनुबंध की स्पष्ट ििों का उल्लंघन है।

अिः आपसे वनिेदन है वक -

बाहर से कचरा लाने पर ित्काल रोक लगाई िाए।

कंपनी को अनुबंध की ििों का कड़ाई से पालन कराने हेिु आिश्यक कारतिाई की िाए। प्रदूषण वनयंत्रण बोडत द्वारा कठोर वनगरानी सुवनविि की िाए।

स्थानीय िनिा की सुविधा हेिु कंपनी से अवनिायत रूप से CSR गविविवधयाँ कराई िाएँ। क्षविग्रस्त प्रधानमंत्री सड़क का ित्काल मरम्मि/पुनवनतमातण कराया िाए।

इस गंभीर समस्या पर िीघ्र संज्ञान लेकर आिश्यक कायतिाही की िाए, विससे स्थानीय िनिा को राहि वमल सके। “

“Subject: Complaint regarding bringing waste from outside, spreading pollution, and damage to roads by Rewa MSW Energy Solutions Pvt. Ltd.

Sir,

With reference to the above subject, it is submitted that MSW Energy Solutions Pvt. Ltd., established at Pahadiya, Bakchhera, Rewa, was contracted by the Municipal Corporation to process municipal solid waste collected from the districts of Rewa, Sidhi, and Shahdol and generate electricity.

However, at present, the company is violating the terms of the contract by bringing large quantities of waste from outside states (especially Prayagraj, Uttar Pradesh) through trucks and burning it.

Due to this act, local residents are facing several serious problems, such as:

Waste falling from trucks coming from outside on roads and hilly areas, resulting in severe filth and pollution.

Local residents are suffering from serious health issues due to foul smell and smoke.

¶38

Due to the movement of heavy trucks, the Prime Minister Road (approximately a 5 km stretch) has been completely damaged, causing extreme difficulty for local people in commuting.

The company is not carrying out any kind of CSR activities in the area.

The Municipal Corporation and the Pollution Control Department are not conducting the required monitoring and action.

¶42

The company is bringing and burning waste from outside solely for private profit, which is a clear violation of the contract terms.

Therefore, it is requested that:

An immediate ban be imposed on bringing waste from outside.

¶45

Necessary action be taken to ensure strict compliance with the contract terms by the company.

¶46

Strict monitoring by the Pollution Control Board be ensured.

¶47

Mandatory CSR activities be carried out by the company for the benefit of the local public.

Immediate repair/reconstruction of the damaged Prime Minister Road be undertaken.

Kindly take prompt cognizance of this serious issue and initiate necessary action so that the local public may get relief.”

None has appeared for the Applicant. However, instead of dismissing the original application in default, we consider it appropriate to grant adjournment.

Even though the present case has been listed before this Bench by registering original application, on the basis of complaint made on the Public Grievances of this Tribunal, with approval and under order of Hon’ble Chairperson, but in view of the facts and circumstances of the case including the fact that the place of accrual of cause of action lies within jurisdiction of the Central Zone Bench of this Tribunal at Bhopal, we are of the considered view that it will be appropriate if the case is heard by the Central Zone Bench of this Tribunal at Bhopal.

Accordingly, the Registry is directed to list the matter before the Central Zone Bench of this Tribunal at Bhopal on 11.03.2026 after

obtaining orders from Hon’ble the Chairperson for transfer of the case, if so required.
