Mr. Rajendra Singh made the present complaint dated 25.08.2025 to this Tribunal on Public Grievances Portal, which has been treated and registered as O.A. No. 68/2026 for exercise of suo moto jurisdiction in view of law laid down by Hon’ble Supreme Court in Municipal Corporation of Greater Mumbai vs. Ankita Sinha, (2022) 13 SCC 401.

“ सर्वप्रथम मैं राष्ट्रीय हररत अधिकरण के प्रधत हृदय से आभार व्यक्त करता हूँ। आपके दूरदर्शी एर्ं दृढ़ धिणवय ं से देर्शभर में अिेक र्ृक् ं की कटाई र की गई है तथा हररत क्ेत् ं का संरक्ण संभर् हुआ है। धर्र्शेष रूप से-

तथा तूतीक ररि (तधमलिाडु) स्थित स्टरलावइट कॉपर संयंत् क बंद करिे का आदेर्शइि ऐधतहाधसक आदेर्श ं िे लाख ं िागररक ं के स्वास्थ्य र् जीर्ि पर सकारात्मक प्रभार् डाला है और देर्श में पयावर्रण संरक्ण की धदर्शा क सर्शक्त धकया है। इसके धलये मैं पूरे न्यायाधिकरण का आभार व्यक्त करता हूँ।

इसी क्रम में सादर धिर्ेदि है धक मैं, एक पयावर्रण प्रेमी िागररक, इंदौर (म.प्र.) स्थित बंद पडी हुकुमचंद धमल के पररसर में धर्कधसत ह चुकी प्राकृधतक हररयाली एर्ं र्शहरी जैर् धर्धर्िता के संरक्ण हेतु आर्ेदि प्रस्ु कर रहा हूँ। त इस हररत क्ेत् का पयावर्रणीय महत्व अत्यंत गम्भीर है-

धपछले 33 र्षों में यह क्ेत् र्शहरी र्ि (Urban Forest) के रूप में धर्कधसत ह चुका है। इंदौर जैसे घिी आबादी र्ाले र्शहर में यह र्ायु र्शुस्थिकरण, तापमाि धियंत्ण, जैर् धर्धर्िता संरक्ण तथा िागररक ं के स्वास्थ्य के धलए अत्यंत महत्वपूणव है।

यधद इस हररयाली क समाप्त कर आर्ासीय/र्ाधणस्थिक धिमावण धकया जाता है, त प्रदूषण, तापमाि र्ृस्थि और यातायात दबार् जैसी समस्याएूँ धर्कराल रूप लेंगी। अतः धिर्ेदि है धक इस धर्षय पर तत्काल संज्ञाि लेकर हुकुमचंद धमल पररसर क िगर र्ि (City Forest) घ धषत करिे एर्ं प्रस्ताधर्त पररय जिा क अन्य भूधम पर िािांतररत करिे के संबंि में आर्श्यक आदेर्श पाररत धकए जाएं।

मैं स्पष्ट् करिा चाहता हूँ धक इस याधचका में मेरा क ई व्यस्थक्तगत लाभ अथर्ा स्वाथव िहीं है। मैं केर्ल ईश्वर और प्रकृधत के प्रधत अपिा कत व धिभा रहा हूँ तथा भार्ी पीधढ़य ं के धलए इस हररत िर हर क सुरधक्त रखिा चाहता हूँ। “

“Subject: Request for the Preservation of Natural Greenery and Urban Biodiversity Developed in the Closed Hukamchand Mill Complex in Indore.

Application to the Hon'ble Tribunal:

In this regard, I submit that I, a nature-loving citizen, am filing this application for the preservation of the natural greenery and urban biodiversity developed in the closed Hukamchand Mill complex located in Indore (M.P.).

The environmental significance of this green area is of utmost importance:

1. Over the past 33 years, this area has developed into an urban forest. Currently, there are approximately 5,000 trees of various sizes in the Hukamchand Mill complex, including species like Neem, Babool, Mango, Eucalyptus, Jungle Jalebi, Peepal, Gulmohar, Banyan, and

others. These trees have created a balanced ecosystem, providing safe habitats for various birds, butterflies, and other creatures.

2. In a densely populated city like Indore, this area plays a crucial role in air purification, temperature control, biodiversity conservation, and the health of citizens.

According to a news article in Dainik Bhaskar (Dated 2nd November 2019, Bhopal edition, Page 3), environmentalists and forest officials have stated, "The ecological services provided by 5,000 new plants will be equivalent to those given by a single 50-year-old large tree after ten years." This clearly indicates the irreplaceable ecological value of mature trees, and their preservation must be a priority under any circumstances.

4. If this greenery is destroyed for residential/commercial construction, it will lead to severe problems such as pollution, temperature rise, and increased traffic pressure.

5. Therefore, I request that immediate action be taken to declare the Hukamchand Mill complex as a city forest and relocate the proposed project to other available land.”

None has appeared for the Applicant. However, instead of dismissing the original application in default, we consider it appropriate to grant adjournment.

Even though the present case has been listed before this Bench by registering original application, on the basis of complaint made on Public Grievances Portal of this Tribunal, with approval and under order of Hon’ble Chairperson, but in view of the facts and circumstances of the case including the fact that the place of accrual of cause of action lies within jurisdiction of the Central Zone Bench of this Tribunal at Bhopal, we are of the considered view that it will be appropriate if the case is heard by the Central Zone Bench of this Tribunal at Bhopal.

Accordingly, the Registry is directed to list the matter before the Central Zone Bench of this Tribunal at Bhopal on 11.03.2026 after obtaining orders from Hon’ble the Chairperson for transfer of the case, if so required.

The Registry is directed to inform the Applicant about the date of hearing fixed and to ask the Applicant to join the proceedings physically or through V.C. and to produce the material available with the Applicant on the date fixed.
