The present application has been filed for grant of regular bail to the petitioner in connection with Dhanbad Cyber P.S. Case No.40 of 2020 arising out of Cyber Case No.98 of 2020, registered under Sections 419/ 420/201/ 120(B) of the Indian Penal Code and Section 66 (C) and 66(D) of the I.T. Act.
Learned counsel for the petitioner has submitted that the petitioner is in judicial custody since 26.09.2020. It has been further submitted that the investigation has already been completed and F.I.R. has been lodged against two named persons and one against the holder of the mobile number. The name of this petitioner has transpired on the confessional statement of the co-accused assigning reason that the holder of the mobile number bearing 9852900333 is also involved in the present case and on that basis this petitioner has been arrested. It has been further submitted that petitioner is ready to co-operate in the trial. Hence he may be enlarged on bail.
On the other hand, learned A.P.P. has opposed the prayer and submitted that there is enough material against this petitioner, which suggests involvement of this petitioner in commission of cyber crime. Further two criminal antecedents have been reported against this petitioner.
Considering the material available on record and the fact that in similar case the co-accused, namely, Vishal Dorji has already been granted bail, the petitioner, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned District & Addl. Sessions Judge-II-cum-Special Judge (A.C.B., Cyber Cases and Electricity Act) Dhanbad in connection with Dhanbad Cyber P.S. Case No.40 of 2020 arising out of Cyber Case No.98 of 2020 subject to the following conditions;
