The present application has been filed for restoration of W. P. (S) No. 510 of 2009, which was dismissed for non-appearance on 11.03.2019.
It has been submitted by the learned counsel for the petitioner that when the case was listed, concerned counsel could not appear due to his personal difficulty and the writ petition was dismissed for non-appearance. It has been further submitted that the writ petition has been filed against the order of dismissal and if the writ petition is not restored, the petitioner will suffer irreparable loss and injury.
Learned counsel for the opposite parties has no objection.
Considering the submission of the petitioner and the reasons given in the instant petition, the present CMP is allowed. W. P. (S) No. 510 of 2009 is restored to its original file.
