The present application has been filed for grant of regular bail to the petitioner in connection with Giridih (T) P.S. Case No.45 of 2015 (G.R. No.421 of 2015), for the offence under Sections 406 and 408 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner is in custody since 10.06.2020 and the investigation is already complete. The dispute is between the employee and the employer. It has been alleged that this petitioner has misappropriated the amount of Rs.8,26,366/- by not depositing the same in the bank account of the company, which was collected from different customers. It has been stated that the petitioner is innocent and he is a victim of office politics. On the basis of above facts, prayer for bail has been made.

On the other hand, counsel for the State has opposed the prayer for bail and submits that there are documentary evidence as well as oral evidence suggesting the involvement of this petitioner in the crime.

Considering the material available on record and the fact that the investigation is complete, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Giridih in connection with Giridih (T) P.S. Case No.45 of 2015 (G.R. No.421 of 2015), subject to condition that the petitioner will submit self-attested photocopy of his Aadhar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
