The petitioner is apprehending his arrest in connection with Sadar P.S. Case No. 14 of 2018 corresponding to G. R. No. 65 of 2018.

It has been alleged that the accused persons had taken loan from the informant for helping the accused persons to start a beauty parlour. An amount of Rs. 19,17,000/- was misappropriated by the accused persons.

It has been stated by the learned counsel for the petitioner that the petitioner had also instituted a case earlier against the informant being Sadar P. S. Case No. 126 of 2017. Learned counsel for the petitioner submits that the dispute appears to be purely on account of a monetary transaction for which the petitioner was claiming certain amount from the informant and others.

Mr. Anjani Kumar, learned counsel for the opposite party no. 2 has stated that the father of the petitioner was granted anticipatory bail, albeit on deposit of Rs. 1,70,000/-. He has further submitted that an amount of Rs. 7 lac had been deposited in the account of the petitioner and therefore, the informant wants return back of the said amount.

On consideration of the fact that the father of the petitioner has been granted anticipatory bail on deposit of Rs. 1,70,000/-, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the petitioner above named is directed to surrender in the court below within six weeks and pray for bail, and if he surrenders along with a draft of Rs. four lacs drawn in favour of the

opposite party no. 2, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Chaibasa in connection with Sadar P.S. Case No. 14 of 2018 corresponding to G. R. No. 65 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.

It is made clear that the said deposit shall be subject to the decision of the trial and without prejudice to the rights of the petitioner.

This application stands allowed.
