08/06.11.2020 Heard Mr. Shahid Yunus, learned counsel for the petitioner and Mrs. Lily Sahay, learned A.P.P. for the State as well as Mr. S.K. Deo, learned counsel appearing for the opposite party no. 2.
The petitioner has prayed for grant of anticipatory bail, as he is apprehending his arrest in connection with Madhupur (Mahila) P.S. Case No. 26/2018.
The marriage of the informant was solemnized with the petitioner three years back. It has been alleged that there was a demand of Rs. 50,000/- and a motorcycle and on nonfulfillment of which she was subjected to torture and ultimately ousted from her matrimonial house.
This Court vide order dated 07.08.2020 had referred the matter to the Secretary, DLSA, Deoghar for making efforts to arrive at an amicable settlement. Consequent to the efforts at the mediation report has been submitted by the Secretary, DLSA, Deoghar from which it appears that the matter has been compromised between the parties and the petitioner has taken back the opposite party no. 2 along with her child to his house. In the mediation both the parties had agreed to have full affection and faith upon each other.
On consideration of the fact that the matter has been amicably settled between the parties, I am inclined to extend the privilege of anticipatory bail to the petitioner. The petitioner accordingly is directed to surrender before the

learned court below within a period of four weeks and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Madhupur in connection with Madhupur (Mahila) P.S. Case No. 26/2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This application stands allowed.
