The petitioner is apprehending his arrest in connection with Complaint Case No. 1142 of 2017 corresponding to T. R. No. 1096 of 2019.

The marriage of the complainant was solemnized with the petitioner in the year 2005. It has been alleged that after marriage, there was a demand of motor-cycle and Rs. 50,000/- in cash and on nonfulfillment of which, she was subjected to torture and ultimately ousted from her matrimonial house.

It appears that vide order dated 07.08.2020, the matter was referred to the D.L.S.A., Giridih for taking efforts for mediation. Consequent to mediation, a report has been submitted by the Secretary, D.L.S.A., Giridih, from which it appears that the matter has been resolved on certain terms and conditions enumerated therein.

Mr. Naresh Pd. Thakur, learned counsel for the opposite party no. 2 has submitted that the opposite party no. 2 does not have any grievance against the petitioner.

On consideration of the fact that matrimonial dispute between the petitioner and the opposite party no. 2 has finally been settled in course of mediation, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the petitioner above named is directed to surrender in the court below within four weeks and pray for bail, and in that event, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten

Thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Giridih in connection with Complaint Case No. 1142 of 2017 corresponding to T. R. No. 1096 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
